What is a Trademark?
"Trademarks" include words, logos, designs, symbols or slogans used to distinguish one's goods or services from those of others. A trademark may be registered or unregistered. A registered trademark is a trademark that has been registered at the relevant trademark office. An unregistered trademark is, not surprisingly, a trademark that has not been registered in United States, trademarks are entitled to legal protection whether they are registered or not. Registration, however, provides trademark owners with certain advantages in enforcing their rights to those trademarks.
Why Protect Trademarks?
When used properly, a trademark identifies one's goods or services as being distinct from those of others. For example, each Party Pong product bears one or more trademarks that will identify it as being a product sold under license by Party Pong. Through such use, Party Pong trademarks have come to represent the high standards of quality that is associated with Party Pong Corporation. As a result, the trademarks of Party Pong Corporation are considered valuable business assets worth millions of dollars.
Used improperly, however, a trademark can become diluted or fall into generic use, losing its protected status. For example, words such as "escalator" and "zipper" were once trademarks that became generic because they were not properly protected by their owners.
As the protection of its valuable trademarks is important to Party Pong, we have created the following guidelines to answer common questions about proper use of Party Pong trademarks.
When is Permission Required?
The use of Party Pong trademarks almost always requires written permission from Party Pong. On occasion, however, permission is not required provided you adhere to certain guidelines regarding the use of trademarks. The following guidelines are provided to help you to determine if permission is necessary.
1. Referential Use
You may use Party Pong trademarks or product names (but not logos) to refer specifically to Party Pong products provided your use is not disparaging, and provided your use does not mislead the public as to Party Pong sponsorship, affiliation or endorsement of your company, products or services.
Please refer to the Guidelines for Using Party Pong Trademarks for specific information on proper trademark usage. For a list of Party Pong registered trademarks and their proper attribution, please refer to the Party Pong Registered Trademark List.
You may make referential use, but not brand use, of Party Pong trademarks in single volume book titles (not series, periodicals or magazines), provided that such books do not use any Party Pong logos or trade dress; and provided the title page or copyright page includes a disclaimer of association with Party Pong.
3. Product Logos and Trade Dress
Party Pong logos and trade dress may never be used by third parties except under a license or by following written guidelines from Party Pong.
Please provide written expression directly to Party Pong Corporation, Permissions Department indicating the intent for use and requesting permission following Guidelines for Using Party Pong Trademarks directly via United States Postal mail to request permission to use Party Pong logos. Email or any electronic form will not be accepted and not granted. Party Pong Corporation will return a decision of grant within 60 days of receipt of the request.
4. Corporate Logo
The Party Pong corporate logo(s) may only be used by third parties who are authorized by Party Pong to do so.
If you are simply referring to "Party Pong Corporation" as a trade name, no trademark symbol is required and no logo should be used.
If you are referring to "Party Pong products", the registered trademark symbol may appear either at the upper right or at the baseline of the word "Party Pong", but the Party Pong corporate logo(s) should not be used.
If you wish to use the Party Pong corporate logo(s) and you are not currently authorized to do so, please contact the Permissions Department to request permission.
5. Domain Names
Party Pong does not allow third parties to use "Party Pong" any other Party Pong trademarks or product names in an Internet domain name.
Party Pong does not object to you placing a link on your Web site to the Party Pong Web site, provided you comply with the guidelines for linParty to www.partypongtables.com
Guidelines for Using Party Pong Trademarks
The following are general guidelines for the use of Party Pong trademarks. If you are a party to an agreement with Party Pong, please consult the terms and conditions of such agreement as it may contain special provisions regarding your use of Party Pong trademarks.
1. Use the Appropriate ® or ™ Symbol
A trademark that has been registered with a trademark office in the applicable jurisdiction is noted with a ®. A trademark that has not been registered with a trademark office is noted with a ™. Party Pong requests that when you refer to our trademarks and registered trademarks you refer to them properly. Proper reference includes the use of the appropriate ® and ™ symbol at the first and most prominent reference, or as soon as practicable thereafter. For information regarding unregistered trademarks owned by Party Pong, please contact the Permissions Department.
Once marked, it is not necessary to mark subsequent appearances of the trademark in the work; however, all headings, titles and subtitles in the work that reference Party Pong trademarks should contain the proper attribution. It is not necessary to include ® or ™ symbols in table of contents or indexes.
If the character set of your project lacks special symbols and superscript characters, use the following substitute trademark notices. Note the capitalization and spacing.

2. Provide Appropriate Trademark Attribution
Include an attribution statement when using any Party Pong trademarks. The statement should read:
"[All of Party Pong's trademarks used, beginning with "Party Pong" followed by any other marks in alphabetical order] are trademarks or registered trademarks of Party Pong Corporation and/or its subsidiaries in the United States and/or other countries."
If it is not feasible to include the attribution statement (and if it is not required by any agreement you may have with Party Pong), it is acceptable to use a general-purpose attribution statement in a form such the following:
"All other trademarks are the property of their respective owners."
3. Use Party Pong Trademarks as Proper Adjectives
Trademarks are adjectives used to describe a specific person, place or thing. As a result, Party Pong trademarks must be used as an adjective with a generic noun at the first and most prominent use of the trademark in any document or section of a document (e.g. at the first use in each chapter of document), and as often as possible thereafter.

4. Trade Name vs. Trademark
The term "Party Pong" when used to refer to a Party Pong product is a trademark and its use is governed by the general guidelines set out in this section. However, when "Party Pong" is used in text only to refer to Party Pong Corporation, it is being used as the company's trade name, not as a trademark and is not subject to general trademark usage rules. For example, it is permissible to use "Party Pong" in the possessive if it is clearly being used as a trade name rather than as a trademark, as in "Party Pong's products." When "Party Pong" is used as a trade name, no trademark symbol or attribution is necessary (i.e. do not use the ® symbol).

11. Never Combine a Party Pong Trademark With Your (or Another Third Party's) Trademark/Product Name
Party Pong trademarks are used to distinguish products manufactured and sold under license by Party Pong from those of others. Combining Party Pong trademarks with trademarks or product names of others would confuse consumers as to which company is the source of the product.

All listed trademarks are owned by Party Pong Corporation. Where a product name consists of more than one trademark, proper attribution must be given for each trademark.

Party Pong does not object to you placing a link from your Web site to the www.partypongtables.com Web site provided you comply with the following guidelines and the regulations contained in the Logo Link Application Form:
If you wish to use a Party Pong logo as an active link from your site, you must complete a Party Pong Logo Link Application Form and comply with the Logo Link Usage Guidelines. If you do not want to use a Party Pong logo, but instead want to refer to our company name or product name in a simple font and format, using appropriate words such as "Click here to visit www.partypongtables.com", you must follow the guidelines set out below.

You may link to, but not replicate, Party Pong content
You may not present false information about Party Pong products or services on your Web site

Logo Link Usage Guidelines and Regulations
Proper usage of the Party Pong logo (the "Logo") requires compliance with the following guidelines:
The Logo must always be a single active link to the Party Pong home page at www.partypongtables.com (the "Party Pong Site"). See the HTML code provided below. By linking to the Party Pong Site, you agree to be bound by the Party Pong Site Terms and Conditions of Use.
Required HTML Code - New Browser Window Use
The following code must be used to place the Logo on your HTML page. The Logo itself must be located in the same directory as the HTML page that references it:
Changes to Your URL
Any change to your placement of the Logo on your site requires the completion of a new Logo Link Application Form.
There is only one version of the Logo. The required size of the Logo is 100 by 35 pixels. The Logo may NOT be displayed in a larger size, even if all elements of the Logo are increased in size proportionately. Your web page title and other trademarks and logos must appear at least as prominently as the Logo.
The Logo must be placed by itself in a prominent location on your site. The Logo may not be used as a feature or design element of any other logo. The Logo must not be used in conjunction with a high-contrast background.
No Alteration Allowed
The Logo must not be modified or distorted in ANY way. Do not shrink it, take it apart, change its proportions, color or font, or otherwise alter it from the Party Pong-supplied version.
Your site must display the Logo in a positive manner. The Logo may not be used to depict Party Pong or its products negatively, or in a manner that could reflect adversely on Party Pong or its products and services, including, but not limited to uses which could be deemed to be obscene, pornographic, excessively violent or otherwise in poor taste or unlawful, or which purpose or objective is to encourage unlawful activities.
Your web page title and other trademarks and logos must appear at least as prominently as the Logo.
You may not display the Logo in any manner that implies sponsorship, endorsement or license by Party Pong.
You may not display the Logo on any site that infringes Party Pong's intellectual property or other rights, or violates any state, provincial, federal or international law.
Party Pong reserves the right to change the Logo Link Usage Guidelines and Regulations at its sole discretion upon ten (10) days electronic notice of such changes.
The Logo is a proprietary logo of Party Pong Corporation. It contains Party Pong's trademark and may be used only with the permission of Party Pong. The Logo Usage Guidelines do not grant a license or any other right in Party Pong's logos or trademarks. Use of the Logo acknowledges Party Pong's ownership of such logos and trademarks (collectively referred to as the "Marks") and does not create any right, title or interest in or to the Marks. All use of or goodwill associated with the Marks ensures to the benefit of Party Pong.
Party Pong reserves the right in its sole discretion to immediately terminate or modify permission to use the Logo at any time. Further, Party Pong reserves the right to refuse permission to use the Logo and to decline your Logo Link Application Form. Party Pong may visit participating sites to ensure compliance with the Logo Link Usage Guidelines and Regulations. Party Pong reserves the right to take action against any use that does not conform to the Logo Link Usage Guidelines and Regulations, infringes any Party Pong intellectual property or other right or violates other applicable law. Upon termination, you agree to immediately remove the Logo from your site and disable your link to Party Pong's homepage.
Party Pong disclaims any warranties that may be express or implied by law regarding the Logo, including warranties against infringement.
The Logo may only be used with the permission of Party Pong.
